General Terms of Agreement
Stud Dog Owner and Bitch/Litter Owner enter into this agreement for Stud Service with the intent to produce a healthy live litter of puppies with a good representation of the Cavalier King Charles Spaniel Breed.
The stud owner certifies that the stud dog is healthy at the time of breeding and has passed his OFA certifications for heart, eyes, and patellas which are available for viewing on the OFA website (ofa.org). The stud has also had DNA analysis which is viewable on our website.
The bitch owner will provide documentation of her passing OFA certifications of heart, eyes, and patellas to the stud owner to ensure that healthy offspring will be produced.
The bitch owner agrees that puppies will be registered with the AKC and will be sold as pet only, limited registration with a spay/neuter contract. The bitch owner may retain full registration of any puppy that is kept in their personal program via ownership or co-ownership status.
No puppies shall be sold to pet stores, puppy mills or puppy brokers.
Breeding
Live Coverage: The method I prefer. Always the freshest and strongest sperm counts. Progesterone testing is requested to ensure optimal timing for you to travel to our home for mating. The bitch owner certifies that their bitch is free of disease and parasites and neither the bitch nor the kennel mates have been ill in the past 60 days. A negative Brucellosis test no older than 14 days will be required. Collection and side by side AI can be performed if the dogs do not tie on their own. Boarding with us during heat to allow for multiple opportunities to tie and/or AI can also be arranged for a fee of $50 per day.
Fresh Chilled Shipped Collection: Timing is everything. Prior experience with this process or at least a good education and plan with your vet is a must prior to requesting. I must have a proper prior notification at least 1 month prior to anticipated heat and at the first signs of heat or I can not ensure availability to collect the sample or that I will have available shipping containers or semen extender to send it in. Progesterone testing of the bitch will be required to ensure optimal dates for collection, shipping, and ultimately resultant pregnancy. These results need to be sent to the stud owner that day as well. Sperm collection will be performed by the Stud Dog owner and will be over night shipped. You may receive up to two collections, if desired. This may be subsequent back to back day collections and mailed in the same shipment or separate shipments (at the bitch owner’s discretion), or you may choose 2 shipments with collections spaced out with a day between collection. Your plans need to be specified in advance so the stud owner may appropriately plan for collection. The bitch owner is responsible for the cost of stud collection along with the cost of shipment. This is due at the time of shipment. This is in addition to the stud fee. Please be aware that over-night shipment for specimens to arrive on a Monday are not available. The latest collection for a Monday arrival will be Saturday morning with arrival to the shipping site by noon on Saturday. Also, there can not be overnight delivery for arrival on Sunday. So, please co-ordinate appropriately with your reproductive veterinarian. There is semen extender shipped with the semen, but the best quality, and therefor odds of implantation, will be from the freshest available sample. Over-night shipment will be chosen with tracking, but I can not be held responsible for failure of the mailing system (FedEx, UPS, USPS).
Definition of Live Litter
For the use of this contract, the definition of a live litter of puppies is considered to be 2 live puppies at the age of 2 weeks. If the bitch does not whelp a litter of at least 2 live puppies that survive to the age of 2 weeks, the stud dog owner will provide one repeat breeding at the next heat cycle, up to 9 months after initial breeding attempt, given the stud is available for studding at that time. Transfer of repeat breeding attempt to a different bitch during that timeframe may occur, per the bitch owners discretion, if she also meets all appropriate health testing requirements and is pre-approved by the stud owner. Any costs incurred by repeat breading (ex: recollection and shipment of semen for AI) will be the responsibility of the bitch owner.

Half of the stud fee is payable on or before breeding or collection/shipment. This is non-refundable. The second half will be payable when a live litter has been confirmed at two weeks of age. At that time the stud owner will release authorization for AKC litter registration.
Stud fee may be exchanged for pick of the litter in approved bitches, or 2nd pick if the bitch owner plans to keep a puppy for themselves. Release of authorization for AKC litter registration would then occur at the time of pick up of the puppy by the stud owner.
Any vet costs and shipment costs for AI will continue to be the responsibility of the bitch owner and is non-refundable.
Acknowledgement
I have read and understand the conditions and terms of this agreement. Any other written agreements agreed to by both parties will be added as an addendum to the agreement.
I agree that I have received the health clearances via access to OFA and Embark databases and understand the information as it has been provided. This agreement originates in the state of Arkansas in Washington County and is therefore bound by the laws thereof. In the event of a breach of agreement, both parties agree to be subject to the jurisdiction of the Arkansas courts of Washington County, AR. All legal fees and court costs incurred shall be the obligation of the Bitch Owner including all those incurred by the stud owner should litigation occur. Should any part of this agreement be found to be illegal or invalid or unenforceable in a court of law, the remainder of this contract shall remain valid and enforceable.
