The puppy has been examined by our veterinarian and is to the best of our knowledge healthy at the time of purchase.  The puppy has received his first set of vaccinations and de-worming on _______ and will be due for his next round of vaccines in 2-4 weeks, by _________.   The Dam and Sire have been DNA tested and cleared from having episodic falling syndrome (EFS) along with dry eye and curly coat syndrome (DECC).  They have been OFA certified and their certifications can be viewed on the OFA website.  We guarantee the puppy for one year from the date of purchase to be free from the life threatening genetic defects EFS and DECC and to be healthy at the time of purchase.  We also test our Dam and Sire for degenerative myelopathy (DM) and those results are viewable on our website as well. The DM gene in cavaliers is not well understood, but it appears to affect a very small percentage of those with both copies of the gene at a very geriatric age.  It is for this reason that we display our dogs' results for your knowledge but there are no guarantees given regarding this gene.

 

The buyer accepts responsibility for the care of this dog.  This includes, but not limited to: providing a loving home, maintaining the dog on a proper diet to maintain weight sensible for its size, age, and breed.  The buyer must provide regular care including vaccines at 12 weeks, 16 weeks, 4 months, and 1 year or as per recommended by the veterinarian.   The buyer must maintain the dog on medication to prevent tick and flea infestation along with heartworm prevention.  

 

If any immediately life threatening genetic defects (testable on a DNA panel) become apparent by the dog's first birthday that would significantly reduce the lifespan of the dog, the puppy needs to be returned promptly. Buyer must provide a signed statement from a licensed veterinarian along with a signed copy of this contract.  We will take the puppy for a second opinion (at our expense) and if both veterinarians are in agreement the puppy will be replaced, not refunded, with one of your liking when one becomes available.   The seller will not be responsible for any cost accrued by your veterinarian visits or any testing that you have performed.  Genetics are often multifactorial and are often polygenetic in inheritance.  If your vet believes a condition is genetic, but there is not a genetic test available on a commercially available genetic testing kit, there would be no way for us to have avoided this, and unfortunately can not be covered.

Please note that umbilical hernias are extremely common in the breed.  They are repairable at 12 weeks or older but are often repaired at the time of spay/neuter if they do not self correct.

If the puppy has not been taken to a licensed veterinarian by __________, this contract will be considered null and void.   If any of the follow up veterinarian visits during the first year for check-ups and vaccines are not met within 2 weeks of their due date, this contract will be considered null and void.  

 

There will be a $500 deposit in order to reserve a dog via Zelle or Venmo.  No refunds of the deposit will be made unless there is a noted problem by our veterinarian with the dog.  At that time we will offer you the option of choosing a different dog if one is available, or refund of the deposit.  

We will accept cash or cashier’s check for the remainder of the balance at the time of puppy pick up.  There will be no refunds of the purchase price.  If any warranted life threatening genetic defects become apparent, upon return of the dog and our veterinarian’s examination concluding life threatening genetic defect, the dog will be replaced with one of your liking when one becomes available. 

 

We will not arrange shipment of the dog because we do not want the dog to fly in cargo.  The dog will need to be picked up in person at our home or at the airport, if you are flying in to pick up the dog.  If you do plan to fly with the dog, you will need to ensure that the airline will allow you to carry the dog onto the plane as a carry-on.  You will be responsible for any associated fees and providing of your own pet carrier.  If your puppy requires a certificate of health for travel by the vet prior to traveling, that will be done for you, but the cost of the certificate will be your responsibility and you will need to give me 2 weeks time to arrange this appointment with our vet.  I have found that domestic flights do not need this certification, but these rules change regularly and you should do your own research on this topic prior to arranging pick-up.

If your puppy is staying with us longer and is due for their subsequent vet visits and vaccinations beyond the first visit, they will be done, but the cost will also be the responsibility of the buyer prior to pick-up.

 

If for any reason in your puppy’s life you cannot keep him, please contact us.  Although we cannot refund the original purchase price, we can help find a loving home.  

 

Acknowledgement

I have read and understand the conditions and terms of this agreement.  Any other written agreements agreed to by both parties will be added as an addendum to the agreement.  

This agreement originates in the state of Arkansas in Washington County and is therefore bound by the laws thereof.  In the event of a breach of agreement, both parties agree to be subject to the jurisdiction of the Arkansas courts of Washington County, AR.  All legal fees and court costs incurred shall be the obligation of the buyer should litigation occur due to breech of contract.  Should any part of this agreement be found to be illegal or invalid or unenforceable in a court of law, the remainder of this contract shall remain valid and enforceable.

Full Registration

If you have been approved to obtain full registration on a dog, there will be an extra cost of $1500.  This gives you the potential to breed and/or show the dog.  There will be no refunds of this potential.  This cost does not ensure that the approximately 10 -12 week old puppy that you receive will meet these expectations at the age of 2 years.  The dog should have proper health testing performed and passed prior to your breeding of the dog.  We have taken all of our dogs for their health testing prior to breeding and their results are given to you on our page and are listed through the OFA for your viewing and knowledge. Unfortunately, despite how I wish it did, it does not guarantee that the offspring will also pass these tests, nor does it guarantee the future fertility of the dog.  I cannot guarantee your potential, I can only ensure that we have tried our best to breed healthy dogs.  I also cannot guarantee that the puppy will be a show dog.  Obtaining a puppy at this age is just too young to predict this potential as showing does not even start until 6 months of age and Cavaliers typically peak with best show potential due to growth, coat, and temperament at 18-24 months.
